Doe Family v. Doe Landlord
Attorneys LaFave and Chifcian represented a family against their former landlords in Pacific Beach and settled their mold exposure/personal injury claims for $850k as part of a confidential settlement. LaFave and Chifcian represented a family of four, including two young children against the owners at a rental property in Pacific Beach which suffered from a plumbing leak and serious crawlspace moisture which resulted in mold growth. Plaintiffs alleged that all four of the family members suffered personal injuries including one of the boys suffering short term hearing loss at the time when he was acquiring speech (around age three), which resulted in speech delays and developmental issues. Plaintiffs argued that the home suffered from a lack of preventative maintenance and that once the landlords were aware of the mold problem, they did not properly remediate it, including failure to use containment. Plaintiffs also alleged other damages including attorney’s fees and costs pursuant to the lease agreement, loss of use, out of pocket investigative costs, as well as a claim for punitive damages based upon the breach of implied warranty of habitability causes of action.
